Acceptance of these terms
These Terms of Service ("Terms") are an agreement between you and HIII PTE. LTD ("HitMind", "we", "us") governing your access to and use of hitmind.ai and the HitMind application at hitmind.ai/app (together, the "Services"). By creating an account or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you use the Services on behalf of a business, you confirm that you have the authority to bind that business to these Terms.
What HitMind does
HitMind is an AI-assisted SEO platform. Depending on your plan, the Services let you run site audits, pull in performance data from Google Search Console with your authorization, generate SEO briefs and article drafts with AI, and, if you choose, publish that content to sites you connect, such as WordPress. Some features are still evolving; we describe a feature’s status clearly in the product before you rely on it.
Your account
- You must provide accurate information when creating an account and keep your login details, or your email or Google sign-in, secure.
- You are responsible for all activity under your account. Contact us immediately if you suspect unauthorized access.
- You must be legally able to enter into a contract, and must have the right to connect any site or domain you add to HitMind, either because you own it or because you are authorized to manage it on the owner’s behalf.
Acceptable use
You agree not to:
- Use the Services for anything unlawful, or to publish content that infringes another party’s rights, is defamatory, or violates applicable law.
- Connect a domain or Search Console property you are not authorized to manage.
- Reverse-engineer, scrape, or resell the Services without our written permission.
- Interfere with the Services’ operation, or attempt to bypass usage limits, rate limits, or security controls.
AI-generated content and publishing responsibility
HitMind’s AI drafts audits, briefs, and articles based on the data you connect and the instructions you give it. Like all AI systems, it can make mistakes: factual errors, outdated information, or claims that do not hold up. You are responsible for reviewing any AI-drafted content before it is published — in HitMind, or in your destination’s drafts if you use automatic drafts — whether you publish it yourself or use HitMind’s publishing feature.
When you connect a destination, such as WordPress, and approve an article, you are directing us to deliver that article to the destination on your behalf, strictly according to the authorization and settings you choose. Unless automatic drafts are turned on for a site (see below), nothing is delivered without your approval: every draft stays in review until you approve it in the app. Whether you approved an article yourself or it was delivered under automatic settings you chose, you remain the publisher of record for that content and are responsible for its accuracy, legality, and compliance with any platform or professional rules that apply to you. HitMind is not responsible for the consequences of publishing content that you approved, or that was delivered under automatic settings you chose.
Automatic topics and drafts. An owner or admin of your workspace can turn on automatic handling for a site in Settings → Autonomy. With automatic topics on, HitMind approves its daily topic picks for writing on your behalf, within your plan’s allowance. With automatic drafts on, HitMind approves a draft on your behalf only when it passes our automated quality check and nothing in it needs a person’s review (a possibly invented brand claim, for example), and delivers it to your WordPress drafts — never as a published post. Placeholder images and internal-link placeholders don’t stop a draft: they are removed or turned into plain text on delivery, exactly as when you approve a draft yourself. Our quality check scores SEO structure; it does not verify facts or clear rights, so please review automatic drafts in WordPress before you publish them. Automatic approvals use your plan’s allowance the same way your own approvals do. Drafts for a Webhook destination are never approved automatically. Before automatic handling starts, we ask you to confirm our publisher notice. You can switch either setting back to review at any time, and every automatic step is listed in the app.
Most destinations receive your approved article as a draft, which stays unpublished until you publish it yourself. A Webhook destination works differently: HitMind sends the article to an endpoint that you operate, and what happens next — whether it is held as a draft or published immediately — is determined by your own system. HitMind cannot hold, recall, or delete an article once it has been delivered to your endpoint. You confirm that you understand this when you connect a Webhook destination.
If you believe HitMind published something in error or outside your authorization, contact us immediately and we will help you investigate and, where appropriate, revert the change.
Third-party integrations
The Services connect to third-party platforms you choose to authorize:
- Google — connecting Google Search Console requires you to grant HitMind read-only access through Google’s own OAuth consent screen; your use of Google’s services remains subject to Google’s terms.
- WordPress — publishing to your WordPress site requires connection credentials that you provide and control; you are responsible for the security of your own WordPress installation.
- Webhook — if you connect a Webhook destination, HitMind sends approved articles to an endpoint you operate and signs each request with a secret shown to you once at setup. You are responsible for verifying that signature, for the security of that endpoint, and for what your system does with an article after it arrives.
We are not responsible for outages, changes, or errors originating from these third-party platforms.
Fees, billing, and cancellation
Paid plans, pricing, and billing cycles are described on our Pricing page at the time you subscribe. Unless stated otherwise, subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from Settings; cancellation takes effect at the end of your current billing period; after a 72-hour grace window your workspace moves to the free plan, and your data is handled as described in our Privacy Policy. The free plan includes a one-time allowance of 3 articles at no charge and requires no card. It is a one-time allowance rather than a timed trial, and it does not reset. Paid subscriptions are charged from the start of the first billing period. Once a charge goes through, fees are non-refundable, except where required by law, or where we fail to provide a paid service because of an issue within our control that we cannot reasonably resolve.
Intellectual property
Your content stays yours. You retain all rights to the site data you connect, the facts and instructions you provide, and the drafts and articles HitMind generates and publishes for you. You grant us a limited license to process that content solely to provide and improve the Services for you.
We own HitMind. The Services themselves, including our software, design, the HitMind name and logo, and our documentation, are owned by HIII PTE. LTD and protected by intellectual property law. These Terms do not grant you any rights to our trademarks or brand assets beyond what is needed to use the Services.
Service availability and changes
We aim to keep the Services reliably available, but do not guarantee uninterrupted or error-free operation. We may modify, add, or discontinue features as the product evolves, and will try to give reasonable notice before a change materially reduces functionality you rely on.
Term and termination
These Terms apply for as long as you use the Services. You may stop using the Services and close your account at any time from Settings. We may suspend or terminate your access if you materially breach these Terms, use the Services in a way that creates legal or security risk for us or other users, or if required by law. On termination, your data is handled as described in our Privacy Policy.
Disclaimers
THE SERVICES, INCLUDING ANY AI-GENERATED CONTENT, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-DRAFTED CONTENT WILL BE ACCURATE OR ERROR-FREE, OR THAT USING THE SERVICES WILL IMPROVE YOUR SEARCH RANKINGS OR TRAFFIC.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIII PTE. LTD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE THREE MONTHS BEFORE THE EVENT, OR USD 100 IF NO PAID SERVICE APPLIES.
Governing law and disputes
These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws rules. You and HIII PTE. LTD submit to the exclusive jurisdiction of the courts of Singapore for any dispute arising out of or relating to these Terms or the Services.
Nothing in this section removes any protection you have under the mandatory consumer laws of the country where you live, where those laws apply to you and cannot be waived by agreement.
Changes to these terms
We may update these Terms as the Services evolve. If we make a material change, we will post a notice on this page and, where appropriate, notify you by email. Continuing to use the Services after a change takes effect means you accept the updated Terms. The "Last updated" date at the top always reflects the current version.
